Everton and Nottingham Forest will not have any grounds for a comeback or be able to take action despite Leicester City avoiding a points deduction, according to Kieran Maguire.

The finance expert claims that this is because the two sides were shareholders of the Football Association Premier League Ltd on 30 June 2023.

Leicester managed to avoid it as they showed that they had breached rules in the season they were not a Premier League side.

Via X, Maguire wrote: “I do not think so, both Everton and Forest were shareholders in the Football Association Premier League Ltd at 30 June 2023.”

The situation with Leicester City avoiding a points deduction for breaching financial rules, while the Toffees and Nottingham Forest were penalised, highlights a significant inconsistency in how financial regulations are applied within the Premier League.

Leicester managed to sidestep punishment by leveraging their status as a non-Premier League club at the time of the breach, which occurred after their relegation.

This loophole essentially allows clubs to breach rules without consequence if they are not members of the Premier League at the critical reporting date, despite the breaches occurring during their tenure in the league.

This disparity not only underscores a lack of uniformity in the Premier League’s enforcement but also suggests that the rules might be exploited by clubs aware of these technicalities.

The two clubs’ shareholdership status at the time of the rule breach meant they were subject to the league’s sanctions, whereas Leicester’s strategic timing allowed them to escape similar repercussions, illustrating a clear loophole in the system that questions the fairness and integrity of financial governance in English football.
